Information on the transmission of data to the USA

Among other elements, our website contains tools by companies based in the USA. When these tools are active, your personal data can be transmitted to the US server of the company in question. Please note that the USA is not a safe third country within the meaning of EU data protection law. US companies are obligated to surrender personal data to security authorities without you, the affected party, being able to take any legal action against this. Therefore, it is not possible to rule out the possibility of US authorities (e.g. the intelligence service) processing, analysing and permanently storing your data for monitoring purposes if this data is located on US servers. We have no influence on these processing activities.

Withdrawing your consent to data processing

Many data processing procedures are only possible with your explicit consent. You can withdraw your previously granted consent at any time. The lawfulness of the data processing performed up to the point of the withdrawal remains unaffected by the withdrawal.

Right of objection to data collection in particular cases and objection to direct advertising (Art. 21 of the GDPR)

IF DATA PROCESSING IS PERFORMED BASED ON ART. 6, PARA. 1E OR F OF THE GDPR, YOU HAVE THE RIGHT TO OBJECT, AT ANY TIME, TO THE PROCESSING OF YOUR PERSONAL DATA FOR REASONS RELATING TO YOUR PARTICULAR SITUATION; THIS ALSO APPLIES TO PROFILING BASED ON THESE PROVISIONS. THE RELEVANT LEGAL FOUNDATION ON WHICH PROCESSING IS BASED CAN BE FOUND IN THIS DATA PROTECTION STATEMENT. IF YOU FILE AN OBJECTION, WE WILL NO LONGER PROCESS YOUR AFFECTED PERSONAL DATA UNLESS WE CAN PROVE COMPELLING AND LEGITIMATE GROUNDS FOR ITS PROCESSING THAT OUTWEIGH YOUR INTERESTS, RIGHTS AND FREEDOMS OR IF THE PROCESSING OF THIS DATA SERVES THE PURPOSE OF ASSERTING, EXERCISING OR DEFENDING LEGAL CLAIMS (OBJECTION IN ACCORDANCE WITH ART. 21, PARA. 1 OF THE GDPR).

IF YOUR PERSONAL DATA IS PROCESSED IN ORDER TO CARRY OUT DIRECT ADVERTISING, YOU HAVE THE RIGHT TO OBJECT, AT ANY TIME, TO THE PROCESSING OF YOUR PERSONAL DATA FOR THE PURPOSE OF THIS TYPE OF ADVERTISING; THIS ALSO APPLIES TO PROFILING WHERE THIS IS CONNECTED TO THIS TYPE OF DIRECT ADVERTISING. IF YOUR FILE AN OBJECTION, YOUR PERSONAL DATA WILL THEN NO LONGER BE USED FOR THE PURPOSE OF DIRECT ADVERTISING (OBJECTION IN ACCORDANCE WITH ART. 21, PARA. 2 OF THE GDPR).

Right of appeal to the relevant supervisory authority

In the case of breaches of the GDPR, the affected party has the right to appeal to a supervisory authority, in particular in the member state of its usual abode, its workplace or the location of the alleged breach. The right of appeal exists without prejudice to other administrative or judicial remedies.

Right to data portability

You have the right to have any data that is processed automatically by us based on your consent or as part of the contractual fulfilment handed over either in principle or specifically to a third party in a standard machine-readable format. If you request the direct transmission of the data to another responsible person, this will only be performed if technically feasible.

SSL or TLS encryption

This website uses SSL or TLS encryption for safety reasons and in order to protect against the transmission of confidential content such as orders or enquiries that you send to us as the site operator. You can identify an encrypted connection by the fact that the address line of your browser will change from “http://” to “https://” and the padlock symbol will appear in your browser bar.

When SSL or TLS encryption is activated, the data you send to us cannot also be accessed by third parties.

Information, deletion and rectification

Within the context of the applicable legal provisions, you have the right to receive information regarding your stored personal data, its origin and recipients and the purpose of data processing free of charge and at any time; where applicable, you also have the right to the rectification or deletion of this data. You can contact us about this or any other questions regarding personal data at any time.

Right to limitation of processing

You have the right to request that the processing of your personal data be limited. You can contact us at any time to do this. The right to limitation of processing exists in the following cases:

  • If you have doubts as to the correction of your personal data stored by us, we usually need time to check this. You have the right to request that the processing of your personal data be limited for the duration of these checks.

  • If the processing of your personal data was/is being performed unlawfully, you can request that the data processing be limited rather than requesting the deletion of the data.

  • If we no longer require your personal data but you still require it in order to exercise, defend or assert legal claims, you have the right to request that the processing of your personal data be limited rather than requesting the deletion of the data.

  • If you have filed an objection in accordance with Art. 21, Para. 1 of the GDPR, your interests and our interests must be weighed up. If it remains to be established whose interests outweigh the other party’s, you have the right to request that the processing of your personal data be limited.

  • If you have restricted the processing of your personal data, this data must–apart from its storage–only be processed with your consent or for the purpose of asserting, exercising or defending legal claims or in order to protect the rights of another natural or legal person or for reasons of substantial public interest of the European Union or a member state.

Objection to advertising e-mails

The use of contact details published under the obligation to provide company information is hereby contradicted if used for the purpose of sending advertisements and informational materials that have not been explicitly requested. The website operators expressly reserve the right to take legal action in the case of the unrequested sending of advertising information, e.g. in the form of spam e-mails.
